The Service includes both tournanaut.com and app.tournanaut.com.
2. Eligibility
You must be at least 13 years old to use the Service.
3. Account Registration
You agree to:
- Provide accurate information
- Maintain confidentiality of login credentials
- Be responsible for all activities under your account
Authentication is provided via Auth0 and may include Google login.
We are not responsible for:
- Security breaches caused by weak passwords
- Failures of third-party authentication providers
4. Acceptable Use
You must not:
- Use the Service for unlawful activities
- Upload data without proper legal basis
- Upload sensitive personal data
- Infringe intellectual property rights
- Harass or abuse other users
- Scrape or extract data
- Circumvent security measures
5. Organiser Responsibilities
If you create or manage tournaments:
- You are solely responsible for tournament rules and outcomes
- You must obtain all necessary participant consents
- You are responsible for compliance with data protection laws
6. Organiser Indemnification
You agree to indemnify and hold harmless MLSoftware OÜ from any claims, fines, damages, or losses arising from:
- Tournament organisation
- Participant disputes
- Uploaded personal data
- Regulatory actions related to your tournament
This obligation survives termination.
7. Content and Moderation
We may remove or suspend content or accounts that violate these Terms or applicable law.
By submitting content, you grant us a non-exclusive licence to host and display it for operating the Service.
8. No Guarantee of Tournament Outcomes
We do not:
- Verify participant identity
- Guarantee fairness or accuracy
- Resolve disputes between participants
The Service is a technical platform only.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
We make no warranties regarding:
- Uptime
- Accuracy
- Fitness for a particular purpose
- Error-free operation
Use is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages
- We are not liable for lost profits, lost data, or business interruption
- Our total aggregate liability is capped at €100
Nothing limits liability where exclusion is prohibited by law.
11. Security and Internet Risks
You acknowledge that:
- No system is completely secure
- Internet transmission carries inherent risk
- We implement reasonable safeguards but cannot guarantee absolute security
12. Force Majeure
We are not liable for failures due to events beyond reasonable control, including technical outages, cyberattacks, governmental actions, or natural disasters.
13. Assignment
We may transfer or assign the Service to another legal entity (for example, if the Service is sold or restructured).
Your continued use constitutes acceptance of the new provider.
14. Governing Law
These Terms are governed by Estonian law.
Disputes shall be resolved in the courts of Estonia, unless mandatory consumer protection law requires otherwise.
